TOPEKA, Kan. — A sperm donor is being ordered to pay child support to a couple he helped have a child.
William Marotta says he gave up all legal rights to the little girl.
But under Kansas law, because the couple didn’t use a doctor to get pregnant with Marotta’s sperm, the state says he’s responsible for the monthly child support payments, according to FOX 4.
Marotta met the lesbian couple through a Craigslist ad seeking a sperm donor.
The post made by couple Angela Bauer and Jennifer Schreiner — William Marotta and his wife responded.
“They were a couple. They couldn’t have children by themselves. Its something I could help with,” Marotta told FOX 4.
Marotta says he didn’t receive any payment and signed away any parental rights long before the little girl was born.
But in October 2012, Marotta says the Kansas Department for Children and Family Services informed him he was being ordered to pay $200 a month in support.
According to court documents, the state argues that because the insemination was not performed by a licensed doctor, the sperm donor contract was null and void.
Marotta believes the state’s argument is at least partially politically motivated.
“I think if this was a lesbian couple in southern California I don’t think it would even be an issue right now,” he said.
Marotta says the child’s mothers fully support him and have told the state they are the ones who should be held responsible.

I'm not surprised, I was audited by the IRS when I donated sperm to UCLA and wrote if off as sending my kids through college.

You might want to read the story again. It's the state that is ordering it; the two women agree with the donor.

something is missing or this article isn't correct, why would he be charge or asked to pay child support. Either 1. The couple probably wanted to collect welfare or government assistance thus having court issue a child support case on the guy or 2. they filed for child support and back tracked once it went national or 3rd they probably wanted the guy to be involved in the kids life, promptly custody battle of some sort and thus child support case evolved. We will never know, news / journalism isn't what it used to be. Everything in the media is written with a hidden agenda.

It sounds like they may have filed for public assistance. I know when I did during my separation, they asked about child support and said that it would HAVE to be established.

Money hungry is all they are

Is that it? Or do they think any sperm donor should pay for the result of his donation?

Hey, this is Kansas, folks – land of "evolution is only a theory so creationism needs to be treated with just as much scientific believability" – in other words, no doubt it's the states ham-handed way of foisting their Bible-related (read: ignorant and stupid) belief system on a couple who don't live the way deemed appropriate.

Doesn't surprise me. The courts don't care about where the money comes from as long as its not from them in the form of welfare checks. I've known guys who were ordered to pay child support for kids that aren't theirs. One lived together with some girl for 8 years before splitting up. He was orders to pay child support. Another one was married with a girl and her two kids for 4 years. He was ordered to pay for child support as well. It was explained to them that courts don't care who the biological parents are, they care about the "well being of the child." So if the court thinks that it's "in the best interest of the child" for Kim's BF or ex husband to pay child support, even it they are not his bio kids or he never adopted them, then they are ordered to pay up. For what I've been told, this is very common. So if you at dating a girl with kids and are thinking about moving in with her, think twice about it, and then think about it some more.

If they can't afford to have a child, why should someone else pay for it??????????
January 4, 2013 at 2:31 PM
That should apply to all people, not just lesbians. Right? There should be a cap on how much money you can collect for your kids. X amount for the first kid, half that amount for the 2nd, zero more for any more kids.
