Family Disputes Account of Homeowner Who Shot Rialto Man Breaking Into Home

Relatives on Monday were questioning the circumstances surrounding the death of a 20-year-old Rialto man who was shot and killed Sunday morning while allegedly trying to break into a neighbor home.

Andy Garcia was at his younger sister’s graduation party Saturday night when he got into an argument with his sister’s boyfriend, family members said.

He had been drinking and his cousins were trying to drive him to his grandmother’s house to cool off, according to his mother, Maxine Flores.

But before they could, Flores said her son got out of the car and ran toward a neighbor’s house.

Shortly afterward, those at the party heard gunshots.

The homeowner claimed he warned Garcia to leave several times and only fired when he felt his family’s safety was at risk, Rialto police Capt. Randy de Andapolice said.

The case was being turned over to the District Attorney’s Office, which will determine if any charges will be filed, De Andapolice said.

Garcia’s family doesn’t believe the neighbor’s story and were planning on taking legal action.

    Sounds good to me. Here’s an idea….don’t break the law. You’ll prolly live longer. Family should pursue legal action…against themselves.
