Noe Torres is set to be arraigned Monday on one count each of murder, assault on a child causing death and arson of an inhabited structure or property, the Los Angeles County District Attorney’s Office announced.

On Oct. 21, Torres stabbed 13-month-old Rosario T. with a knife during an argument with the child’s mother at their apartment in the 13000 block of Vanowen Street, prosecutors said.

At the time of the crime, police initially said a man had thrown the baby out of the second-story apartment window before setting fire to the unit, but they later corrected that explanation.

Torres set fire to the apartment, stabbed himself and then jumped out of the window with the unit behind him in flames, according to the DA’s office.

Witnesses and police said they saw him with a knife sticking out of his chest. The child’s mother rushed her to the hospital, where she died.

Torres is due to appear in Van Nuys court on a warrant that was filed Oct. 25.

If convicted as charged, he faces up to 34 years to life in state prison. His bail has been set at more than $2 million.
